The Initial Consultation
At your free initial consultation, we will examine a number of factors to determine whether or not you qualify for Chapter 7 bankruptcy. We will discuss your property and assets, including vehicles, investments and bank accounts, as well as your debts. To make the initial consultation more efficient, we encourage you to bring any pay stubs, bills, bank statements, tax returns or other documents related to your debt.
Can You Keep Your Assets During Bankruptcy?
If you file for Chapter 7 bankruptcy, a number of your assets will be exempted from liquidation. For example, you can keep your home if you have $20,000 or less in equity ($40,000 if you are filing jointly with your spouse) and you can keep a vehicle for which you have less than $2,500 in equity.
How Long Does the Chapter 7 Process Last?
From the time of your bankruptcy filing, there will usually be three to five months before your debt is discharged. After your free consultation, we will begin preparing your bankruptcy filing. In some cases, we are able to complete filings on the same day of the consultation. After the filing, the next step is the meeting of creditors (341 meeting), which you must attend. We will be there at your side, guiding you through the process.
